Terms & Conditions - Four Little Pigs - Kids Interiors

These terms and conditions ( the “Terms and Conditions”) govern the use of www.fourlittlepigs.co.uk (the “Site”). This site is owned and operated by Four Little Pigs - Kids Interiors. This site is an e-commerce website. By using the Site you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times. 

These terms and conditions contain a dispute resolution clause that impacts your rights about how to resolve disputes. Please read it carefully. 

Intellectual Property 

All content published and made available on our Site is the property of For Little Pigs- Kids Interiors and the Site’s creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site. 

Exclusive Rights and Ownership of Content:

By entering into this design project agreement, the Client acknowledges and agrees that the Four Little Pigs - Kids Interiors shall have exclusive rights to publish, display, and use any content created or produced as part of the design project on social media platforms, websites, or any other promotional materials, and that Four Little Pigs - Kid Interiors is the sole and exclusive owner of all such content. This content includes, but is not limited to, design renders, videos, photographs, and any other media or creative materials generated during the course of the project.

The Client further agrees not to reproduce, distribute, or use any of the aforementioned content without prior written consent from Four Little Pigs - Kids Interiors. The Client acknowledges that Four Little Pigs - Kids Interiors may use this content for promotional, marketing, or portfolio purposes, both during and after the completion of the project.

This provision shall survive the termination or expiration of this agreement and remains in effect indefinitely.

Sale of Goods 

These Terms and Conditions govern the sale of goods available on our Site. 

The following goods are available on our Site:

  • Interior design service; and 

  • Soft Furniture and Accessories 

We are under a legal duty to supply goods that match the description of the good(s) you order on our Site. 

These terms and conditions apply to all the goods that are displayed on our Site and the time you access it. This includes all products listed as being out of stock. All information, descriptions or images that we provide about our goods are as accurate as possible. However, we are not legally bound by such information descriptions of images as we cannot guarantee the accuracy of all goods we provide. You agree to purchase goods from our Site at your own risk. 

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. 

If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument and verify receipt of any refund. 


Third Party Goods and Services

Our Site may offer goods and services from third parties. We cannot guarantee the quality or accuracy of goods and services made available by third parties on our Site. 

Payments

We accept the following payment methods on our Site:

  • Credit card 

  • PayPal and 

  • Debit card

When you provide us with your payment information You authorise us to adjust the amount due to this payment instrument.  If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

Right to Cancel and Receive Reimbursement 

If you are a customer living in the United Kingdom or European Union you have the right to cancel your contract to purchase goods from us within 14 days without giving notice.  The cancellation period: 

  • Will end 14 days from the date of purchase when you purchase the digital content that was not supplied for a tangible medium. 

To exercise your right to cancel you must inform us of your decision to cancel within the cancellation period. To cancel contact us by email hello@fourlittlepigs.co.uk or by post at 57 Oak Grove,  Poynton, SK12 1AD, or 20 Dewlands, Oakley, MK43 7RL. 

The right to cancel does not apply to: 

  • Goods or services other than the supply of water gas electricity or District heating where the price depends upon fluctuations in the financial market that we cannot control and that may occur during the cancellation period;

  • Custom or personalised goods, including designs

  • Goods that will deteriorate or expire rapidly; and 

  • Newspapers magazines and periodicals except for subscriptions to such publications 

Effects of Cancellation 

If you provide express consent to the supply of digital content during the cancellation period and acknowledge that your right to cancel the contract is lost by the supply of digital content during the cancellation period, you will no longer have a right to cancel the contract.  We will process the refund using the same form of payment as used for the initial purchase unless you have expressly agreed otherwise. You will not incur any fees because of the reimbursement.

The right to cancel and to reimbursement is not affected by any return or refund policy we might have. 


Customer Protection Law

Where the Sale of Goods Act 1979, the Customer Rights Act 2015 or other customer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is conflict between these Terms and Conditions and that legislation, the mandatory provisions of this legislation will apply. 


Links to Order Websites 

Our Site contains links to third-party websites or services that we do not own or control. We are not responsible for the content, policies or practices of any third party website or service linked to on our Site. It is your responsibility to read the terms and conditions and privacy policies of these third party websites before using these sites. 

Limitation of Liability 

Four Little Pigs - Kids Interiors and our directors, officers, agents, employees, subsidiaries and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

Indemnity 

Except where prohibited by law, by using this Site you indemnify and hold harmless Four Little Pigs- Kids Interiors and our directors, officers, agents, employees, subsidiaries and affiliates from any actions, claims losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Applicable Law

These terms and conditions are governed by laws of the Country of England. 

Dispute Resolution

Subject to any specified in these Terms and Conditions, if you and Four Little Pigs- Kids Interiors are unable to resolve any disputes through informal discussions, then you and Four Little Pigs- Kids Interiors agree to submit the issue first before a non-binding mediator and to an arbitrator in the event that mediation fails. The decision of the arbitrator will be the final and binding. Any mediator and arbitrator must be a neutral party acceptable to both you and Four Little Pigs - Kids Interiors. The cost of mediation and arbitration will be shared equally between you and Four Little Pigs - Kids Interiors.

Notwithstanding any other provision in these Terms and Conditions you and Four Little Pigs - Kids Interiors agree that you both retain the right to bring an action in small claims court and to bring an action for injunctive relief or intellectual property infringement. 

Severability 

If at any time of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and that the rest of the terms and conditions will still be considered valid.  


Changes

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.

TERMS AND CONDITIONS OF SERVICE

  1. Formation of Contract

    1. These Terms and Conditions describe the services and set out the entire agreement between Four Little Pigs- Kids Interiors (“Service Provider”)  and you (the “Client”) and will apply once an appointment has been made to provide Four Little Pigs-  Kids Interiors’ services (the “Services”).

    2. Before procuring the Services you should read these terms and conditions carefully. If you do not agree with them, do not use the Services.

  2. Four Little Pigs Kids Interiors - Services 

    1. Four Little Pigs Kids Interiors have been retained to remotely provide interior design services only.  Service Provider is not a general contractor and will not act in such capacity. The Client is responsible to take care of all design works required.

    2. Once payment is made Service Provider and Client enter in the Agreement. 

    3.  According to the package purchased - project of a selected interior is sent to the Client in the form of technical documentation (where applicable), along with the accompanying design renders  and a shopping list covering all elements included in the project, and in the case of the Bespoke Packages with a  Custom Furniture Design package, also a furniture design for a carpenter.

    4. Service Provider issues the Client a survey on the email address provided. Client completes the survey and sends it back to Service Provider via e-mail - within 7 days. If the Client does not send back the completed survey within this period - the Service Provider sends him an e-mail with an additional 3-day extension for completing the survey. If the Client does not send the completed survey within the additionally specified period - the Service Provider has the right to withdraw from the Agreement with effect for the future (i.e. retaining the entire payment made by the Client).

    5. After Service Provider receives the survey completed by the Client, the Client will automatically receive an inventory instruction.

    6. Within 7 days of receiving the inventory instruction, the Client is obliged to make an inventory and send the Service Provider its results to hello@fourlittlepigs.co.uk. The inventory includes but is not limited to dimensions and photos of the room to which the ordered project relates. If the Client does not send back the inventory results within this period -  Service Provider sends him an e-mail with an additional 3-day extension for sending the inventory results. If the Client does not send the inventory results within the additionally specified period - Four Little Pigs Kids Interiors has the right to withdraw from the Agreement with effect for the future (i.e. retaining the entire payment made by the Client).

    7. Service Provider will check the inventory within 5 working days. If any inaccuracies are detected, a request for clarification will be sent to the Client, with a specified deadline; if the Client does not send back the specification of the inventory within this period -  Service Provider sends him an e-mail with an additional 2-day extension for sending the specification of the inventory. If the Client does not send a detailed inventory within the additionally specified period - the Service Provider has the right to withdraw from the Agreement with effect for the future (i.e. retaining the entire payment made by the Client).

    8.  After the Client completes a survey and sends measurements , The Service Provider will set up a start date of the projects and draw up a functional layout (2D room drawing with proposed position of furniture) within 7 working days from the set start date . This will be reviewed and approved by the client within an additional 5 working days. If the client requests amendments, The Service Provider will work on a second draft, based on client’s feedback.  

    9. After the Client approves functional layout, The Service Provider will draw up a 3D concept within 10 working days. This will be reviewed and approved by the client within 5 working days. If the client requests amendments, The Service Provider will work on a second draft, based on client’s feedback which will be submitted within 10 working days from receiving Client’s feedback. If the client chooses to change their mind once the design has been agreed or if any further amendments need to be made this will incur a cost.

    10. After concluding all amendments, the design will be approved.

    11. The Service Provider will provide the Client with the final design of the room in the form of 3D renders along with a shopping list in an electronic form, covering all the elements included in the project and any other accompanying documents where applicable. With the transfer of the fully completed project to the Client the Service is considered complete.

    12. After handing over the final design, the Client is obliged to verify the shopping list within 5 working days. 

    13. The Service Provider is not responsible for any irregularities in performing the inventory on the part of the Client, in particular for incorrect measurement of the room to which the ordered project relates.

    14. Due to the nature of the Interior Design business we cannot guarantee that Clients will always like our recommendations. Interior Design can be subjective. Unfortunately, we cannot provide any refunds in this case. However please feel free to contact Four Little Pigs Kids Interiors and we will be happy to discuss the design concept further over the phone and perhaps make further recommendations via phone/email in special cases.

    Client Obligation

    1.  The Client is obliged to use the Website in a manner consistent with the law, the Regulations and decency, and in particular to use the Website in a way that does not interfere with its functioning, in particular through the use of specific software or devices.

    2. The Client is obliged to complete the survey sent from hello@fourlittlepigs.co.uk and to provide accurate measurements of the room following the guidance provided by The Service Provider within the specified times in paragraph 2.

  3. Payment and Billing Terms

  1. The charges for the services are set on the website (fourlittlepigs.co.uk) in the tab Packages & Prices.

  2. All payments should be made through our website or bank transfer and are made ahead of the Service Provider and Client entering in the agreement. 

5.  Cancellation and Termination Policy

  1. The Client has the right to cancel this contract (the “Contract”) at any time up to the end of  14 days after the day on which the Contract is concluded, subject to the following provisions. The cancellation cannot be exercised by the Client after their submission of the Survey.

  2. To exercise the right of cancellation as set out in clause 5.1, the Client must give written notice to Service Provider by post or email at Four Little Pigs Kids Interiors address or email as set out in Terms & Conditions.

  3. Once the Client has notified The Service Provider that the Client is cancelling the Contract, The Service Provider will within 30 days refund the Client for the Services.

  4. Termination of contract will not affect either party’s outstanding rights or duties, including  Service Provider’s right to recover any money owing to them under these terms and conditions.

7. Liability

  1.  Service Provider shall have no Liability to the Client for any loss, damage, costs, expenses or other claims for compensation arising from any information or instruction supplied by the client which is or are incomplete, incorrect or inaccurate.

  2. Service Provider shall not be liable to the Client for any unforeseeable loss or damage arising from the provision (or non-provision) of the Services, including loss of profit or consequential loss or damage.

  3. Neither Service Provider, nor the Client shall be liable for any failure to perform its duties under this Contract due to circumstances beyond its control, including without limitation flood, fire or otherwise adverse weather conditions.

  4. To enable Service Provider to deal with any complaints that may arise relating to the Services, the Client must provide full details of any complaints within 7 days of the supply of the relevant services.

  5. Nothing in these Terms and Conditions affects any liability for death or personal injury caused by Service Provider’s negligence or for fraudulent misrepresentation, or the Client’s statutory rights as a consumer.

Privacy Policy

We never supply any data to third parties.

All names and contact details (email address) on the Four Little Pigs Kids Interiors Mailing List are stored on MailChimp, which is GDPR compliant. (MailChimp and Squarespace are a marketing automation platforms and email marketing services and a trading names of their operators).

All names and contact details (telephone number, email address, postal address) for client purposes are stored in a password protected webportal.

All online card payments, names, and personal details on the Four Little Pigs Kids Interiors online shop are stored on Paypal, which is GDPR compliant.

The term “purchase” will relate to one or more items selected.

Pricing

All prices shown on www.fourlittlepigs.co.uk are in Pound Sterling (GBP).

Products from www.fourlittlepigs.co.uk can be ordered via the online shop, or email. We accept payments by PayPal through the online shop, and BACS transfers via invoicing.

Please allow 3-5 working days for the bank transfer to occur. Purchase orders will be dispatched once the payment has been received and cleared.

Lead Times

Due to the time to make each product and facilitate shipment, our lead times vary from 2-8 weeks for bespoke items.

All other items from Four Little Pigs Kids Interiors will be dispatched within 3-5 working days, dependent on stock levels and international suppliers’ lead times.

Depending on the size of the order, the time scale of making and delivering may vary. However, if there is an urgent requirement for an order, we will do everything we can to meet your order needs. Please email hello@fourlittlepigs.co.uk to let us know prior to ordering and check our current lead times.

Overseas orders are accepted and delivery charges will be quoted upon receipt of your order. Charges may vary and will be added onto the confirmation email once the purchase order has been made.  Please contact us for a quote in advance of placing your order.

Returns

At Four Little Pigs Kids Interiors, we understand that sometimes you may wish to request a refund or exchange.

We ask that you request your returns within 14 working days of receiving your order by emailing hello@fourlittlepigs.co.uk

You have 7 further working days to return an item(s).

Please quote your order number which you will find on your order confirmation email and your full name. Please explain the reason why you want to send your item(s) back. If an item is faulty, please provide full details within 72 hours.

All items must be returned in the condition that you received them, with all tags still attached and box packaging included where applicable.

How to Return Your Purchase?

You as the Client are responsible for the payment of postage/shipping for returns. Four Little Pigs Kids Interiors will not pay the postage of any unwanted items unless they are faulty.

Should you receive a faulty item we will arrange a refund of shipping charge once goods have been received.

To return an item;

  1. Please post back to the address provided, after you have emailed us.

All products must not be returned without prior arrangement. Refunds for faulty handmade products are strictly limited to the replacement of faulty goods only.
